Due to a recent Massachusetts Supreme Court ruling: diminished value claims are no longer viable in Massachusetts. This is because all auto insurance policies in Massachusetts are written and approved by the state for all insurance companies in Massachusetts to follow. Currently, the Massachusetts Auto Liability Policy contains a specific exclusion for “any reduction in value”. This exclusion is in the liability portion of the Massachusetts Auto Policy which is the coverage from which a claim for diminished value would be paid.
Note: You may still be able to receive compensation for the diminished value of your vehicle, however, it would require a claim being made directly to the at-fault driver and may require you to file a lawsuit. You should seek the advice of a licensed attorney for consultation.
