Massachusetts Diminished Value

Due to a recent Massachusetts Supreme Court ruling: diminished value claims are no longer viable in Massachusetts. This is because all auto insurance policies in Massachusetts are written and approved by the state for all insurance companies in Massachusetts to follow. Currently, the Massachusetts Auto Liability Policy contains a specific exclusion for “any reduction in value”. This exclusion is in the liability portion of the Massachusetts Auto Policy which is the coverage from which a claim for diminished value would be paid.
